We are operating exclusively on basis of the “Allgemeine Deutsche Spediteurbedingungen” (German Freight Forwarders´ Standard Terms and Conditions, ADSp), latest edition. In clause 23, the ADSp limits the legal liability for loss or damage to goods according to § 431 of the German Commercial Code (HGB), for damages whilst in Forwarder´s custody with Euro 5.00/kg; for multimodal transportations with the inclusion of a carriage by sea with EUR 2.00/kg, together with a limitation each claim / each occurrence with EUR 1.0 Mill. / EUR 2.0 Mill. or 2 Special Drawing Rights (SDR)/kg, whichever amount is the greater. Additionally, it is agreed that clause 27 of the ADSp does neither extend the liability of the forwarder, nor the attribution of a culpability of people or third parties in favor of the principals, deviant from statutory provisions like article 25 of the MC, article 36 of the CIM, article 21 CMNI or § 660 of the German Commercial Code (HGB)
